It is unclear whether the men have been charged with rape or not. The following article seems to suggest that so far they have only been charged with illegal immigration, not rape:

Police vow to work nonstop to link 82 arrested suspects to Krugersdorp gang rape

About halfway down the above article notes: The 82 men arrested in the wake of the incident have been charged only with being in South Africa illegally.
