Sounds like any other "he said" vs. "she said" case to me.

Since DNA revolutionized criminal investigation, a rapist's only defense is "she consented".  Get used to it, gonna hear it a whole lot more often.
Also, accusers, even those who actually have been raped, often feel the need to embelish the details of their attack to make it more believable, or to evoke greater sympathy.  Throwing in a non-existant weapon is a common tactic.

Bottom line is, no proof MUST equal no conviction. 

The one thing both parties agree on is that she gave him an unearned $1,000.   
So make him give it back. Tell them to stay the hell away from each other.
Case Closed---next case!

Sounds like there was proof to me, Ray:



"After subjecting his victim to a serious sexual assault that left her with significant genital injuries, Burgess, who had broken in by smashing a window, forced his victim to shower while he tried to clear up the evidence.

Next, he stole items from her home including a bottle of wine and $60 from her purse before making her put on dark glasses, drive to an ATM, and hand over $1,000.

Burgess, who left damning DNA and fingerprint evidence at the scene, was arrested three days later "ہ“ on the day of his mother's funeral. He pleaded not guilty to aggravated burglary, serious sexual assault, robbery and deprivation of liberty. He claimed in court that the woman picked him up from the Ducking Stool area of Pembroke where he was living in a tent, and took him to her house for consensual sex."







Um...not to mention the part where we're supposed to believe a female homeowner picked up a homeless drug-addict in the middle of the night for some consensual, unprotected sex?  What the fuck ever.

And also not to mention the part where he's got a history of breaking and entering AND rape:






"Kingsley Eugene Burgess, convicted this week of breaking into a woman's home and raping her, had previously blindfolded and raped a tourist in her hotel room.

The plumber and mason, who was jailed for the maximum 30 years for his latest attack, struck at the Coral Island resort in 1978, The Royal Gazette can reveal.

He had only recently been released from jail having been convicted of a series of burglaries. In addition to the rape of the tourist, he was found guilty of assault with intent to rape and entering a dwelling house with intent to rape and jailed for ten years in March 1979.

The judge said Burgess had a total of 16 previous convictions for breaking and entering to his name, many involving the theft of expensive jewellery.

He had only been released from prison three months before he struck in Pembroke on November 12 last year



All sounds pretty damning to me.
