Odd law, that thankfully the legislators are working to correct, but until they do, there is no rape or sodomy if the victim is unconscious or intoxicated.

It isn't a law that says you can rape them if they are drunk or unconscious, it is a law that doesn't list it as rape in the criteria. If you give them the drugs you are still preforming rape. The omission from the law shouldn't (even though it has been) be allowed to stop prosecution. Now where does it say you can't kill someone if they are asleep but it has never been a defense for murder. "Well they were sleeping and the law doesn't forbid me taking their life then."

It is only in reference to the oral sodomy not the rape. They dropped the oral rape part of the charge because of lack of evidence.
