Consent is not rape

Let me say before starting that I am not defending this guy in any way, but even at the age of 16 these girls went to that hotel working for an escort service and
they knew damn well they were going there for sex.  That is not rape.  He did pay for sex with someone who was a minor and for that he deserves the punishment, but
rape I am not so sure.

It's hard to say really, especially with them being escorts. The article claims the girls were victims of sex trafficing but what's their definition of trafficing? We (society as a whole) have this tendency to label EVERYONE who does sex work as a victim of trafficing, is that their definition? Are they simply girls who CHOSE to escort for whatever reason or are they actual victims of trafficing who were forced into sex work through violence and slavery? i can understand their position with thinking the girls were raped if they were actually victims of trafficing and forced to do sex work against their wills. But is it still rape if they were just horny teenagers who thought why not make a few bucks doing something i like? What if they are doing sex work out of necessity, because it's simply to best/only option availible to support themselves? Is it still rape then? i don't think we have anywhere near enough information to make any kind of solid determination here.

I have never agreed with the definition of rape in statutory rape. Saying the person did not give her consent because she could not (legally) give consent is a technicality at best, and diminishes the impact the word rape has, imo.

The Determination of Mr. Fogle's future now is in the hands of a Judge in New York. If he or she determines that Jared Fogle deserves the Maximum Punishment under the Plea Deal, which was to length of Incarceration, not where it was to be served, and the amount of his Monetary Penalties.

If His or Her Honor wants to Sentence Jared Fogle to serve his Time in Attica, that's where he'll serve his Sentence. If the Judge believes a lesser Prison is warranted, he will be sent there. But have NO doubts, wherever he goes, Jared Fogle will be at the Bottom of the Prison Food Chain. Child Molesters and Rapists are universally despised in Prisons. He will have to be placed in Protective Custody, and Serve his Sentence  in a Special Handling Unit to keep him safe......

As to his victims, it doesn't matter if they were paid escorts or not. Under New York State Law, 16 is still considered a Minor, and unable to Legally Consent to ANY paid Sexual Act.....

True, though what I feel is being discussed here is not what the law says, but whether it should say that or not. Or, more to the point, whether it should be considered rape or not.

While I do believe there should be an age of consent (which age that should be and how to settle it being an entirely different matter), even when said age is disrespected, while still being a crime, I would not caracterize as rape.
